Terms of Service and Privacy Policy

“Customer”: means any person using the Website to contact a User for any opportunity based on the User’s Portfolio.
“Portfolio”: means the User’s information shared by them on the Website.
“Services”: include the platform through the Website to connect Users and Customers.
“User”: means any person having a registered account on the Website.
“Website” or “Bawabba”: means www.bawabba.com.
“Data”: means any information posted by the User and customer to describe the services they provide on the Website.
"Lead": means any inquiry or job posted by the customer on the Website.

To use the Services of Bawabba, a User is required to register their account on the Website and upload their Portfolios. All Users registered with Bawabba can be searched for by anyone on the internet and their respective Portfolios will be accessible to the public, to the extent the User permits Bawabba to share.
Details like names and qualifications of the Users will always be open for public view so that the Users can be contacted through Bawabba regarding any prospective opportunities by Customers. It is clarified that the personal contact details of the Users such as email and telephone shall not be displayed to the public by Bawabba and the User is free to share the same with other Users/Customers as it may deem fit.
Any Customer, whether a User or not, can view the Portfolio of the User as uploaded on the Website.
Bawabba is not a service provider and merely a platform to connect the Users to the Customers based on the Portfolios of the Users as uploaded on Bawabba.
Bawabba does not hold any accountability for disputes between the user and the customer. Bawabba only forwards leads to the user for which it charges the user a 20% commission for the lead if the deal closes successfully and the user receives the payment. The user is solely responsible for the payment under all circumstances. Payment is made directly to the user as per the terms agreed by the user and the customer in which Bawabba plays no role.
Customers from across the world will have access to the information provided by the Users on Bawabba and such information is not limited to any country.

Any changes made to these Terms will be reflected on the Website from time to time and the User is responsible to keep themselves updated about the same.
To register with Bawabba, a person must be at least 18 (eighteen) years of age or any such age that is recognized as the legal age to enter into a contract in the User’s country of residence.
The User gives Bawabba the right to store their IP addresses and also assents to Bawabba’s use of cookies, beacons, tags and scripts as per the terms of the Privacy Policy.
The User and the Customer agree that under no circumstances will they.
post any incorrect information on the Website.
post any fake review on the Website.
hack, tamper or attempt to gain unlawful or unauthorized access to the Website and the Services in any manner whatsoever.
deceptively obtain any personal information from other Users/Customers. All such activities are considered as “Phishing”.
Bawabba reserves the right to deactivate the account of any User who post false information/review with the view to mislead and misinform other Users and Customers, who attempts to gain unauthorized access or indulges in Phishing, as it may deem fit. Bawabba reserves the right to block such Users/Customers from the Website and pursue appropriate legal remedies as it may deem fit.

The User is responsible for all the personal data that is posted on the Website, including its legality, reliability, and appropriateness.
The User covenants to NOT to post any information that is insulting, derogatory or against the Public morals of the UAE. Bawabba reserves the right to take down and permanently block the User who engages in such conduct.
User represents and warrants that: (i) the data published on the Website is theirs or that they have the right to use it publish it on the Website as provided under these Terms, and (ii) the posting of the data on or through the Website does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. When submitting the data to or otherwise using the Website, the User agrees not to:
submit material that violates a third party’s proprietary rights, including privacy and publicity rights, or that otherwise violates any applicable law;
publish falsehoods or misrepresentations that could materially damage Bawabba’s reputation, its policies, User policies or any third party policies;
publish any private information of someone (including but not limited to companies, individual, organizations and group companies), such as their address, phone number, email address, and similar information without their permission;
submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate;
post advertisements or promote competitive products;
impersonate another person or represent yourself as affiliated with us, our staff or other industry professionals;
solicit a user’s password or other account information; or
harvest user names, addresses, or email addresses for any purpose.

Bawabba has the right to review the User’s account and Portfolio to ensure the User’s compliance with these Terms, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. Bawabba reserves the right, at any time and without prior notice, to remove or disable access to any content that it consider, in its sole discretion, to be in violation of these Terms or otherwise harmful to Bawabba in any manner.
The User can remove the personal data by specifically deleting it. However, in certain instances, some of data (such as posts or comments made) may not be completely removed and copies of User’s data may continue to exist on the Website. We are not responsible or liable for the removal or deletion of (or the failure to remove or delete) any of the User’s personal data.
Any personal communication or interaction between the User and the Customer and/or other Users through the Website is purely at their own risk and discretion and Bawabba shall not, in any manner whatsoever, be liable for any act, deed, loss, claim, injury caused to any person arising out of or as a result of such communication or interaction.

As a result of high internet traffic, transmission problems and system capacity limitations, the User/Customer may, at times, experience difficulty in accessing the Website or communicating with Bawabba through the internet or other electronic or wireless device. Any computer system or other electronic/mobile device used to access the Website can experience unanticipated outages or slowdowns, or have capacity limitations. Bawabba does not guarantee continuous, uninterrupted or secure access to the Website.

The Website may contain features and functionalities that may link the User/Customer to third party content and web domains, which are independent of Bawabba. Use of such links is purely at the User’s/Customer’s discretion.

Our Application includes Google Maps features and contents. By using our application, users are bound by Google’s Terms of Service.

Intellectual Property shall mean any and all intellectual property or proprietary rights of Bawabba including any and all rights over all its data, information, techniques, methodologies and materials, and shall include all rights as applicable relating to any copyright (including rights in audio-visual works), trademarks (including logos, slogans, domain names, trade names and service marks), patents (including patent applications and disclosures), designs, proprietary computer programs and software, source code, object code, rights of priority and trade secret rights, recognized in any country or any jurisdiction.

User/Customer is not permitted to modify, copy, distribute, transmit, resell, redistribute, broadcast, display, perform, reproduce, publish, license, frame, transfer, or otherwise use in whole or in part any content, software, or Intellectual Property contained in the products or services or forming part of the Website except without the prior written approval of Bawabba.

Bawabba is not bound by any agreement with any of its Users/Customers for ensuring security of their intellectual property appearing on the Website. The User/Customer hereby agrees and undertakes to be solely responsible in this regard, in the event of any claim/s or dispute/s that may arise in this regard, alleging infringement of intellectual property by Bawabba.

The User/Customer is entirely liable for activities conducted by them or anyone else in connection with the use of the Website. If the User/Customer is dissatisfied with the Website or any of the Services or with these Terms, their sole and exclusive remedy is to stop using the Website and the Services. Neither Bawabba nor any third party provider will be liable for any claims, costs or damages in connection with the User’s/Customer’s browsing, use of the Website, or any information obtained from the Website.

IN NO EVENT SHALL Bawabba BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF ITS WEBSITE OR THE SERVICES RENDERED OR WITH THE DELAY OR INABILITY TO USE THE SERVICES, THE WEBSITE OR FOR ANY INFORMATION, AND SERVICES OBTAINED THROUGH THE WEBSITE, OR PRODUCT OR SERVICE BOUGHT THROUGH AFFILIATE LINKS, OR OTHERWISE ARISING OUT OF THE USE OF THIS WEBSITE, WHETHER BASED ON CONTRACT OR STRICT LIABILITY OR OTHERWISE. Bawabba MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE USE OF ITS WEBSITE AND SERVICES AS IT IS PROVIDED ON AN ‘AS IS WHERE IS’ BASIS AND Bawabba DOES NOT WARRANT THE SAME AGAINST FITNESS OF USE OR FOR ANY OTHER PURPOSE.

Bawabba shall not be liable for any loss or liability resulting, directly or indirectly, from delays or interruptions due to electronic or mechanical equipment failures, telephone/internet downtime or associated problems, defects, weather, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, or other like causes. Bawabba shall have no responsibility to provide User access to our Platform whilst such unforeseen delays or interruptions continue.

Bawabba reserves the right to withdraw the account of any User without prior notice. The User may cancel the account at any time by logging into the App and going to profile settings. Bawabba shall terminate all rights granted to the User/Customer in case of breach of any of these terms.

These Terms are governed by and construed in accordance with the laws of United Arab Emirates. You agree that any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Services (collectively, “Disputes”) shall be referred to Dubai Courts. The courts in Dubai shall have exclusive jurisdiction of all matters arising herein.

Bawabba is committed to protect the privacy of every user (“User”) of our website www.bawabba.com (“Website”). This Privacy Policy constitutes a legal agreement between you as the User of our Website and Bawabba as the owner of the Website.

This Privacy Policy sets out the principles governing our use of your Personal Information (as defined below). The terms of this Policy will apply to the User as soon as you first use our Website and the deemed to have agreed to be bound by it upon your first use of our Website. Should you wish to not continue to be bound by the terms of this Policy, please stop using our Website now.

In addition to this Privacy Policy, our Terms of Use also apply to you as the User of our Website.

All information voluntarily provided by the User to be displayed on their Portfolios at the time of registration on the Website that includes the User’s photos, personal contact details, personal identifiable information, expertise, work experience, etc. shall be construed as “Personal Information”, in accordance with the provisions of Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011.

Personal Information collected from the User will be published on the User’s Portfolios on the Website to the extent permitted by the User. Further, Personal Information collected from the User will not be disclosed to any third party except if required under applicable law or any regulation or any order of the court or any government or non-government authority. User’s Personal Information, to the extent permitted by the User, will be made available on their Portfolios on the Website for public view and may be accessed by Customers to connect with the Users. Bawabba shall protect all such Personal Information provided by the User to Bawabba that is not available for public view. However, Bawabba will not be responsible for any Personal Information shared by the User to a Customer or a Third Party at their own discretion.

Once a User is registered with Bawabba, their account with Bawabba will be password protected for security and privacy.

Bawabba endeavors to take reasonable steps to preserve the integrity and security of User’s Personal Information against unauthorized access, disclosure, reproduction or amendment. However, in the event of an unauthorized disclosure, Bawabba shall not be responsible or liable for any damages (moral or financial) caused due to such disclosure.

In using the Website, the User accepts the inherent security implications of data transmission over the internet, and also agrees that the User will not hold Bawabba responsible for any breach of security unless Bawabba has been grossly negligent or in willful default.

Bawabba may also collect certain non-personal information from the User on their visit to the Website such as information about User’s operating system, browser type, the URL of the web sites visited, their internet service provider and IP Address. This information is used to improve the Website content and performance. Bawabba may in future also share such non-personal information with third party service providers or third party advertisers to measure the overall effectiveness of Bawabba’s online advertising, content, programming and for other bonafide purpose, as Bawabba may desire. By usage of our Website User expressly permits Bawabba to access such non-personal information for one or more purposes deemed fit by Bawabba.

Similar to other commercial web sites, the Website utilizes standard technology called “Cookies” and web server logs to collect information about how the Website is used. This information is collected on an aggregate basis. None of this information can be associated with the User of our Website.

Our Application is using the Google Maps API(s) and incorporate by reference theGoogle’s Terms of Service.

This Privacy Policy shall be governed by and construed in accordance with the laws of United Arab Emirates.

Bawabba may review and update this Privacy Policy on periodical basis. If any material changes are made, Bawabba will notify you by e-mail as specified by the User and same will be updated on the Website.

The User’s browsing and interaction on any third party website including those that have a link on the Website are subject to such third party’s rules and policies. Bawabba shall not be held liable for any unauthorized access of the User’s Personal Information through the use of such third party website/s.

Each of the provisions contained in this Privacy Policy shall be severable, and the unenforceability of one shall not affect the enforceability of any others or of the remainder of this Privacy Policy.

No failure or delay by Bawabba or the User in enforcing any right or remedy in this Privacy Policy shall be construed as a waiver of any future exercise of such right or remedy by Bawabba or the User (as applicable).
